i have a patent. Someone else seems to be ripping me off. What can I do? Violation of your patent it is called an "infringement". You can go to the Federal Court and initiate a lawsuit to seek a restraining order and injunction to prevent or stop further infringement. You also can ask the court to seize and impound the allegedly infringing items or articles while the action is pending. If there was an infringement the articles can be destroyed. An infringer also would be liable for actual damages plus additional profits of the infringer or statutory damages. Further, an infringer could be held liable for injury to business reputation or the dilution in the value of the patent. You also can be awarded costs and attorneys' fees if you prevail.

a patent attorney is an attorney who has the specialized qualifications necessary for representing clients in obtaining patents and acting in all matters and procedures relating to patent law and practice, such as filing an opposition. The term is used differently in different countries, and thus may or may not require the same legal qualifications as a general legal practitioner. The titles patent agent and patent lawyer are also used. The latter is generally used only if the person qualified as a lawyer.

Can I handle my legal problem myself? Sometimes, people cant afford legal representation or they just want to do it themselves. People without legal training may be able to handle some simple legal problems on their own. This is called proceeding pro se or pro per. Handling a legal problem by yourself can be risky, however, because each step may involve tax issues or other legal consequences that you may not think about. Representing yourself requires a lot of time and energy to learn the proper procedures and law. The first thing you will want to do is to learn as much as possible about the law and procedures related to your problem. You will want to get information about the law and courts in your state.

License suspension or revocation traditionally follows conviction for alcohol-impaired driving. Under a procedure called administrative license suspension, licenses are taken before conviction when a driver fails or refuses to take a chemical test. Because administrative license suspension laws are independent of criminal procedures and are invoked right after arrest, they've been found to be more effective than traditional post-conviction sanctions. Forty-one states and the District of Columbia have administrative license suspension laws.

Drunk Driving Penalties: In the last twenty years, the penalties for drunk driving have become far more severe than they were in the past. First-time offenders face potential jail time and fines, although often the penalty for a first-time offense will be something less than jail time in exchange for a guilty plea. Repeat offenders are usually treated more harshly, with substantial fines and mandatory jail sentences that may not be suspended or waived by the court. State administrative regulations often call for suspension or revocation of a defendant's driver's license in addition to any criminal penalty. Defendants have sometimes tried to make the argument that this administrative suspension is double jeopardy prohibited by the U.S. Constitution, but these arguments have never succeeded.

Drunk Driving/DUI - An Overview: The crime of drunk driving is also known as "driving under the influence," or DUI, and "driving while intoxicated," or DWI. In some states, the crime may be known as "operating while intoxicated, or OWI, or "operating under the influence," or OUI. The names vary according to how state law refers to or defines the crime. Whatever the name, the state laws all have a common aim of punishing those who drink and drive, or those who drive while under the influence of illegal drugs. A drunk driving conviction carries with it serious and long-lasting consequences: jail or prison time, a heavy fine, and suspension or revocation of a driver's license. A person who is facing a drunk driving charge should not hesitate to seek immediate legal counsel from an experienced drunk driving defense attorney.

What about legal books? Published legal books can be excellent sources of legal information. Some books are produced by bar associations or government agencies as a public service. Look for them in the self-help or law section of your local bookstore or library. Your librarys reference desk should be able to tell you where to find legal books. Books may not address your particular situation, so you still may want to consult with a lawyer for help with part of your legal situation. Also, make sure a book specifically describes the law in your state, and that it has been published recently older books may not be up-to-date, since the law changes frequently.

can I buy or sell patent rights? Yes, if you are an inventor you may assign all or part of your interest in the patent application or patent to anyone by a properly worded assignment. The patent application itself must be filed in the U.S. Patent and Trademark Office as the invention of the true inventor, however, and not as the invention of the person who purchased the invention from the inventor. Just as deeds to real estate should be recorded with the local county officials to protect the parties’ rights, patent assignments should be recorded in the Patent Office to give notice to the to the public and other potential purchasers.

what is a ‘patent’? A patent is a grant of a property right by the Government to the inventor. The United States Constitution provides for Congress to provide for patents to encourage useful inventions. The patent itself provides a detailed description of the invention, and how it is used or how to make it. Thus if you obtain a patent you can not keep the matter secret, which is the province of Trade Secret Law. A patent enables the owner to exclude others from making, using or selling the invention for the life of the patent.
